TERMS OF AGREEMENT
1. ELIGIBILITY AND PARTICIPANT REPRESENTATIONS
1.1. Health & Fitness Representation
The Participant represents that they are physically, mentally, and emotionally capable of participating in retreat activities, including but not limited to hiking, horseback riding, spa activities, sweat lodge experiences, and ceremonial or spiritual activities. The Participant acknowledges that some activities may be physically or emotionally demanding.
1.2. Medical Disclosure
The Participant agrees to disclose any relevant medical conditions, medications, allergies, or limitations to the Sacred Sites Retreats LLC prior to the retreat.
1.3. Travel Medical Insurance
The Participant must provide proof of purchase of travel medical insurance no later than fourteen (14) days prior to the Retreat Start Date. The policy must include coverage for emergency medical expenses and repatriation.
2. RETREAT ACTIVITIES AND SERVICES
2.1. Nature of Retreat
Sacred Sites Retreats LLC provides experiential retreats that may include outdoor, wellness, cultural, and spiritual elements. These retreats are not medical, therapeutic, or clinical services.
2.2. Plant Medicine Ceremonies
If offered, plant medicine ceremonies are optional, conducted in a ceremonial or traditional context, and are not medical treatment. Participation is voluntary and subject to the liability waiver and informed consent.
2.3. No Guarantees
No guarantees are made regarding outcomes, personal growth, emotional results, health results, or spiritual insights.
3. PARTICIPANT RESPONSIBILITIES
The Participant agrees to:
Follow all instructions, guidelines, and safety rules provided by retreat staff, facilitators, or guides
Act respectfully toward other participants, staff, facilitators, animals, sacred sites, and local communities
Arrive on time for scheduled activities
Respect cultural, spiritual, and environmental protocols
Take full responsibility for personal belongings
Show proof of Travel Health Insurance (Including Repatriation) 2 weeks before Retreat
4. PROHIBITED CONDUCT
To ensure safety and the integrity of the retreat environment, the following are strictly prohibited:
4.1. Substance Use
Illegal drugs of any kind
Alcohol misuse or intoxication
Non-prescribed controlled substances
Sharing or distributing any substances
Exception: Plant medicines may only be used when explicitly provided, supervised, and authorized by Sacred Sites Retreats LLC during designated ceremonies.
4.2 Behavior
a. Harassment, bullying, intimidation, discrimination, or any form of abusive conduct toward participants, staff, facilitators, or local community members is strictly forbidden.
b. Physical violence, threats, or aggressive behavior are grounds for immediate removal from the retreat.
c. Disruptive or disrespectful conduct that interferes with the retreat experience for others will not be tolerated.
d. Sexual misconduct, including unwelcome advances, inappropriate physical contact, or any behavior of a sexual nature that violates the personal boundaries of others, is prohibited.
4.3. Safety Violations
Ignoring safety instructions
Leaving group activities without notice
Reckless behavior during hikes, horseback riding, or ceremonies
4.4 Recording & Privacy
a. Unauthorized photography, audio recording, or video recording of ceremonies, retreat participants, staff, or sacred sites is strictly prohibited unless expressly permitted in writing by the Company.
b. The Participant shall respect the privacy and confidentiality of all individuals and retreat events, refraining from sharing images, recordings, or personal information without prior consent.
5. REMOVAL FROM RETREAT
Sacred Sites Retreats LLC reserves the right to remove any Participant in its sole and reasonable discretion from the retreat, without refund, if the Participant:
Violates this Agreement
Engages in unsafe or disruptive behavior including violations described in Section 3 and Section 4.
Poses a risk to themselves or others
The Participant acknowledges and agrees that any decision regarding removal from the retreat shall be final and binding, and that removal shall not entitle the Participant to any refund, credit, or future participation rights.
6. PAYMENT, CANCELLATION AND REFUNDS
6.1. Payment Terms
All deposits, fees, and payments are subject to the terms presented at the time of booking and any written confirmations issued by the Company.
6.2. Deposits, Refunds and Transfers
Unless otherwise expressly stated in writing by the Company:
a. Deposits are strictly non-refundable under all circumstances.
b. Fees or charges paid in excess of the deposit amount may, at the Company’s discretion, be eligible for either:
i. a refund, or
ii. a transfer or credit toward a future retreat organized by Sacred Sites Retreats LLC.
6.3. Time Limit
Any request for a refund, transfer, or credit of eligible fees must be submitted in writing before ninety (90) days from the original retreat start date. Requests made after this period shall be forfeited.
6.4. Other Non Refund Scenarios and Force Majeure
Missed activities, partial attendance, or early departure from the retreat do not entitle the Participant to a refund, credit, or compensation of any kind.
The Company shall not be liable for cancellations, delays, or changes caused by events beyond its reasonable control, including but not limited to weather conditions, acts of nature, government actions, public health emergencies, illness outbreaks, transportation disruptions, or similar circumstances.
7. ASSUMPTION OF RISK
The Participant acknowledges and understands that participation in the Retreat involves inherent and potential risks, including but not limited to physical injury, illness, emotional or psychological discomfort, environmental hazards, travel-related risks, animal-related risks, and other unforeseen circumstances.
The Participant voluntarily and knowingly assumes all such risks, whether known or unknown, foreseeable or unforeseeable, associated with participation in the Retreat. Execution of a separate Liability Waiver and Assumption of Risk Agreement is required prior to participation.
8. INTELLECTUAL PROPERTY & MEDIA
All retreat materials, content, schedules, photos, videos, and branding are the intellectual property of Sacred Sites Retreats LLC.
9. PHOTO AND VIDEO RELEASE
The Participant hereby grants Sacred Sites Retreats LLC and its representatives the irrevocable right and permission to photograph, film, and/or record the Participant during the retreat, and to use such photographs, video, and recordings, including the Participant’s name and likeness, in any and all media for promotional, marketing, or educational purposes, without compensation or additional approval. The Participant waives any right to inspect or approve the finished product. If the Participant does not consent to photography or recording, they must notify the Company in writing prior to the retreat.
10. NO MEDICAL OR THERAPEUTIC RELATIONSHIP
Participation does not create a doctor–patient, therapist–client, or counselor relationship. No medical advice is provided.
11. GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict-of-law principles.
Any dispute, claim, or controversy arising out of or relating to this Agreement, the Participant’s participation in the retreat, or any related services shall be resolved exclusively through binding arbitration conducted in the State of Wyoming, in accordance with the rules of the American Arbitration Association then in effect.
The Parties knowingly and voluntarily waive any right to have such disputes resolved in court or by a jury trial, except where such waiver is prohibited by law. Arbitration shall be conducted on an individual basis only, and the Participant waives the right to participate in any class, collective, or representative action.
Judgment on the arbitration award may be entered in any court of competent jurisdiction
12. SEVERABILITY
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
13. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the Participant and Sacred Sites Retreats LLC regarding retreat participation and supersedes all prior discussions or representations.
14. ACKNOWLEDGMENT
By joining the retreat, the Participant acknowledges that they have read, understood, and voluntarily agreed to this Retreat Participant Agreement.
